Terms of Service

Summary: By using Candor, you agree to use the service lawfully, understand that analysis results are probabilistic estimates (not legal determinations), and accept that liability is limited to fees paid. Please read in full.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Candor ("Candor," "we," "us," or "our"), governing your access to and use of the Candor deception analysis API, website, and related services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

2. Description of Service

Candor provides a linguistic analysis API that evaluates written text for probabilistic indicators of deception. The Service uses computational natural language processing techniques grounded in peer-reviewed research to generate deception likelihood scores and signal breakdowns.

Candor's analysis outputs are probabilistic estimates only. They are not legal determinations, forensic findings, or definitive conclusions about any individual's truthfulness. See our Accuracy Disclaimer for important limitations.

3. API Usage Terms

Access to the Candor API is subject to the following terms:

  • Authentication: API access requires valid credentials. You are responsible for maintaining the security of your API keys.
  • Rate limits: Your plan's rate limits apply. Exceeding rate limits may result in temporary suspension of API access without refund.
  • Input data: You are solely responsible for the text you submit for analysis. Do not submit text containing personal health information (PHI), payment card data, government-issued ID numbers, or other sensitive regulated data unless you have the legal right to do so.
  • Output use: Analysis results are licensed to you for internal business use only. You may not resell or sublicense raw API outputs as a standalone data product.
  • Reverse engineering: You may not attempt to reverse-engineer, extract, or replicate the underlying models or scoring methodology.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. The following uses are expressly prohibited:

  • Using the Service to make adverse employment, housing, credit, insurance, or benefits decisions as the sole or primary basis for that decision
  • Using the Service in any manner that violates the Equal Credit Opportunity Act, Fair Housing Act, Americans with Disabilities Act, EEOC guidelines, or analogous anti-discrimination laws
  • Processing text from individuals without a legally sufficient basis for doing so (e.g., without consent where required by applicable law)
  • Using analysis scores as evidence in judicial, arbitral, or administrative proceedings without appropriate expert disclosure
  • Submitting text about minors under 13 years of age
  • Attempting to overwhelm, disrupt, or degrade the Service through excessive requests, denial-of-service attacks, or similar conduct
  • Misrepresenting the nature of Candor's analysis to third parties as a legally validated or court-admissible lie detection test

5. Account Termination

Candor reserves the right, at its sole discretion, to suspend or terminate your access to the Service, with or without notice, for any of the following reasons:

  • Violation of these Terms or the Acceptable Use Policy
  • Conduct that Candor reasonably believes poses legal or reputational risk
  • Non-payment of fees
  • Upon request by law enforcement or regulatory authorities
  • Candor discontinuing the Service

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.

6. Intellectual Property

All content, software, algorithms, models, and materials comprising the Service are owned by Candor or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the Service.

You retain ownership of the text you submit. By submitting text, you grant Candor a limited, non-exclusive license to process that text for the purpose of providing the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

CANDOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. ANALYSIS RESULTS ARE PROBABILISTIC ESTIMATES AND MAY BE INCORRECT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CANDOR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO CANDOR IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

IN NO EVENT SHALL CANDOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

9. Indemnification

You agree to indemnify, defend, and hold harmless Candor, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service in violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Any decision you made that was based in whole or in part on Candor's analysis outputs
  • Your submission of text that infringes third-party intellectual property rights or violates privacy laws

10. Modifications to Terms

Candor may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. General Provisions

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Candor regarding the Service and supersede all prior agreements.
